Terms of Use

1. General / Acceptance of Terms

FluentPod websites, mobile applications (“Apps"), and related services (together, the “Service") are operated by the FluentPod Team (“FluentPod," “us," or “we").

By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms of Use. FluentPod may amend these Terms. If we do, we will post a notice for at least 7 days and indicate the last revised date. Revisions become effective at the end of the 7-day period or the first time you access the Service after changes.

If you do not agree, you are not authorized to use the Service.

2. Description of Service

FluentPod provides English learning content aligned with the CEFR framework (A1–C2), including listening materials, exercises, and placement tests. The Service may be offered in part for free or through paid subscription plans.

FluentPod may, in its sole discretion and at any time, update, change, suspend, or discontinue any aspect of the Service.

3. Registration & Account Security

By registering for the Service, you agree to: (i) provide accurate, current, and complete information; (ii) maintain the confidentiality of your password and accept responsibility for all activities under your account; (iii) maintain and promptly update your registration information; and (iv) be fully responsible for all use of your account and for any actions that take place through your account.

FluentPod is not liable for any loss arising from your failure to comply with this section.

4. Acceptable Use

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You may not:

• Use the Service for any illegal purpose or copyright infringement
• Engage in harassment, post hateful or threatening content
• Impersonate any person or entity
• Reverse engineer, decompile, or disassemble any part of the Service
• Use data mining, robots, or similar data gathering methods
• Interfere with or disrupt the operation of the Service

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

5. Intellectual Property

All content available through the Service — including designs, text, graphics, images, audio, software, and other materials — is the proprietary property of FluentPod or its licensors and is protected by applicable intellectual property laws.

No content may be modified, copied, distributed, reproduced, downloaded, scraped, posted, transmitted, or sold in any form without the prior written consent of FluentPod. No data mining, robots, or scraping methods are permitted. All learning activity data (“Activity Materials") is exclusively owned by FluentPod. All rights not expressly granted herein are reserved.

6. Submission of Content

If you submit any content to the Service (including reviews, text, translations, or other materials), you grant FluentPod a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, adapt, modify, distribute, and display such content. This license cannot be terminated once content is submitted.

You represent that you own or have the necessary rights to the content you submit. You may not submit content that is libelous, defamatory, abusive, threatening, hateful, offensive, illegal, or infringing on any third party’s rights.

7. License to Apps

Subject to your compliance with these Terms, FluentPod grants you a non-transferable, non-exclusive license to download, install, and use the Apps on your personal device. You may not derive the source code of, reverse engineer, decompile, or disassemble the Apps. FluentPod retains all intellectual property rights in the Apps.

Apple App Store: If you download the App from the Apple App Store, you acknowledge that these Terms are between you and FluentPod, not Apple. Apple has no responsibility for the Apps and no maintenance or support obligation. Apple is a third-party beneficiary of these Terms.

Google Play Store: If you download the App from Google Play, you acknowledge that these Terms are between you and FluentPod, not Google. Google has no responsibility for the Apps and no maintenance or support obligation. Google is a third-party beneficiary of these Terms.

8. Payment and Refunds

Currently FluentPod is offered free of charge. If paid features are introduced in the future, applicable pricing and payment terms will be communicated. All financial transactions will be processed by third-party payment processors (Apple App Store, Google Play Store).

Refund policies, if applicable, will be set out separately and communicated on the relevant payment page.

9. Third-Party Links

The Service may contain links to third-party websites or services. FluentPod is not responsible for the content or privacy practices of those websites. These Terms and our Privacy Policy do not apply to third-party sites. FluentPod shall not be liable for any damage or loss caused by or in connection with the use of any third-party content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS" AND “AS AVAILABLE." FLUENTPOD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, COMPLETENESS, OR ERROR-FREE OPERATION.

THE SERVICE MAY BE UNAVAILABLE DURING PERIODS OF MAINTENANCE OR FOR OTHER REASONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTPOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, PROFITS, BUSINESS INTERRUPTION, LOSS OR CORRUPTION OF DATA, OR COST OF SUBSTITUTE SERVICES.

FLUENTPOD’S TOTAL LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO FLUENTPOD IN THE 12 MONTHS PRIOR TO THE CLAIM. THIS IS AN AGGREGATE LIMIT.

12. Indemnification

You agree to defend, indemnify, and hold harmless FluentPod and its team members from and against any losses, claims, liabilities, damages, and attorneys’ fees arising from your use of the Service, breach of these Terms, or any false representations made by you.

13. Changes to Terms

FluentPod may update these Terms of Use from time to time. We will post a notice for at least 7 days and indicate the last revised date. Your continued use of the Service after the notice period constitutes acceptance of the updated terms.
